GENERAL CONDITIONS OF SALE
These General Conditions of Sale govern the commercial activity of NAVY PARIS (the seller), domiciled at 5 av Ingres 75016 Paris, France, contact@navyparis.com
Article 1 - Introduction
These General Terms and Conditions of Sale define the rights and obligations of the parties in the context of the sale of products offered by the company NAVY PARIS (hereinafter "NAVY PARIS") from the website www.navyparis.com (hereinafter the "Site"). NAVY PARIS is a simplified joint stock company with a share capital of €10,000, registered in the Paris Trade and Companies Register under number 847 727 674 and whose registered office is located at 5 avenue Ingres - 75016 Paris - France - Tel 09 86 30 14 36. SIRET number 847 727 674 00016. Intra-community VAT number FR 77 847 727 674. The term "Product(s)" refers to the item(s) offered for sale under the Navy Paris brand during each collection on the Site. The term "Customer" refers to any non-commercial natural person wishing to make a purchase on the Site. The term "Order" refers to the sales contract formed between the Customer and NAVY PARIS from the Site, and having as its main object the purchase of one or more Products.Article 2 - Scope and acceptance of the General Conditions of Sale
Any purchase made by the Customer on the Site is subject to these General Terms and Conditions of Sale in force on the date of the Order. NAVY PARIS reserves the right to modify these General Terms and Conditions of Sale at any time. Changes to these conditions will be posted on the Site in order to inform the Customer of their rights. Prior to any Order, the Customer is asked to accept the General Terms and Conditions of Sale by means of a checkbox followed by the words "I have read the general terms and conditions of sale and I adhere to them without reservation". Thus, any Order made from the Site automatically implies acceptance of the General Terms and Conditions of Sale of NAVY PARIS by the Customer. If one or more stipulations of these General Terms and Conditions are held to be invalid or declared as such pursuant to a legislative or regulatory provision, or following a final decision by a competent court, they will be deemed unwritten and the other stipulations will remain in force.Article 3 - Use of the Site
The information or personal data that the Customer communicates will be processed in accordance with the NAVY PARIS Privacy Policy. The latter is accessible at the bottom of the Site, alongside in particular these General Terms and Conditions of Sale and the Legal Notices. By using the Site, the Customer agrees to the processing of this information and contact details, and declares that all information or contact details provided are true and accurate. By using the Site and placing an Order on it, the Customer undertakes to: - Use the Site only for the purpose of carrying out consultations and/or placing legally valid orders. - Not place false or fraudulent orders. Any element suggesting that such an order has been placed would authorize NAVY PARIS to cancel it and inform the competent authorities. - Provide their email address, postal address and/or other contact details that are true and accurate. Similarly, the Customer authorizes NAVY PARIS to use this data to be able to contact him, if necessary, in the context of his Order (see the Privacy Policy). The Customer will not be able to place an Order on the Site if he does not communicate the data required for this purpose. By placing an Order on the Site, the Customer affirms that he is over 18 years old and has the legal capacity to enter into contracts.Article 4 - Prior information
The Site allows the Customer to order, online via the Internet, a selection of Products from the Navy Paris brand. The Products from the Navy Paris brand are presented through a descriptive sheet allowing the Customer to find out in particular the sale price, the amount of any delivery costs as well as the characteristics of the Products. While every effort is made to ensure that the color and pattern of the Products – photos of which are displayed on the Site – are faithful to the original Products, variations may occur, in particular due to technical limitations of color rendering of the Customer's computer equipment. NAVY PARIS cannot therefore be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site. For any questions relating to a Product or an Order, the Customer has the option of contacting NAVY PARIS customer service (hereinafter the "Customer Service") by clicking on the "Contact us" space located at the bottom of the Site.Article 5 - Availability of Products
Navy Paris Products are sold in limited quantities. They are therefore put on sale on the Site until available stocks are exhausted. In the event that a Product proves to be unavailable following an Order, NAVY PARIS undertakes to inform the Customer by e-mail as soon as possible. The Product concerned will in this case be fully refunded to the Customer, at the latest within 14 days via the same payment method as that used when placing the Order. NAVY PARIS shall not be liable in the event of stock shortages or unavailability of its Products. NAVY PARIS reserves the right to change the Products put on sale on its Site at any time and without notice.Article 6 - Order procedure
Any Order only becomes effective once the Customer has validated the payment.
Any Order constitutes acceptance of the prices and descriptions of the Products available for sale, and implies a commitment by the Customer to pay for their Order.
The online provision of the bank card number and the final validation of the Order will constitute proof of the entirety of this order in accordance with article 1366 of the Civil Code.
This validation constitutes signature and express acceptance of all operations carried out on the Site.
6.1. Order Procedure on the Site
6.1.a) Selection of Products
The Product(s) that the Customer wishes to purchase must be added to their selection by clicking on "Add to cart". The Customer can then view their selection by clicking on the "Cart" icon in the menu at the top right where the following will appear for each Product: the reference, the corresponding photo, the color(s), the quantity chosen, the size, the unit price and the subtotal of the selection.
6.1.b) Identification
After selecting the Product(s), the Customer must click on "Order" to start the Order process. The Customer is then free to place his Order on the Site as a guest, or by logging into his account. The Customer is then invited to provide his Title, First Name, Last Name, Email Address, Postal Address and Telephone Number. In order to ensure the proper delivery of Navy Paris Products, the Customer is requested to provide accurate information.
6.2. Validation of Orders placed on the Site
6.2.a) Validation of the delivery method
To date, delivery in France and internationally of Navy Paris Products is exclusively carried out by our partner Colissimo. The Customer is therefore invited to choose this delivery method, then click on "Continue".
6.2.b) Validation of payment of the Order
The Customer is then invited to select a payment method and enter the relevant information. At the end of the process described above and after having accepted these General Terms and Conditions of Sale, the Customer only has to click on the "Validate" button to confirm the Order.
Once the transaction has been completed, the information relating to the Order is transmitted to NAVY PARIS for processing.
NAVY PARIS will then proceed to ship the Product(s) subject to availability and actual payment of the Order.
NAVY PARIS reserves the right not to accept a Customer's Order if there are legitimate reasons to believe that the latter is in breach of these General Terms and Conditions of Sale, that he has engaged in fraudulent activity or for any other legitimate reason.
6.2.c) Summary of the Order
A summary of the Order is then sent by e-mail to the Customer ("Your order is confirmed"). This summary will include the total amount of the Order, information relating to the delivery time and costs, the essential characteristics, quantity and price of the Products purchased.
This email will also remind you of the terms and conditions under which the Customer may exercise his right of withdrawal as defined in Article 11 below.
NAVY PARIS advises the Customer to keep this summary on an electronic medium. The latter will then receive an e-mail confirming the shipment of the Order with an electronic invoice attached. No order may be modified by the Customer once the status of the latter is "In preparation".
6.3. Invoices An invoice is subsequently sent to the Customer in a shipping confirmation email. NAVY PARIS makes every effort to ensure that its communications reach the Customer in a timely manner. However, it is possible that some emails may be considered spam. Consequently, NAVY PARIS advises the Customer to check their spam folder if they have still not received the said shipping confirmation email after several days.
Article 7 - Prices – Accepted Payment Methods
7.1. Price
The price of each Product is indicated exclusively in Euros, all taxes included. The Products are invoiced on the basis of the prices displayed on the Site at the time of the Order. All Products are payable in Euros and must be paid at the time of placing the Order. In the event of unavailability of a Product, only the price and transport costs relating to the available Products will be debited.
7.2. Accepted payment methods
Payment for the Order is made using a Visa, MasterCard, Carte Bleue, e-Carte Bleue bank card or a Paylib or PayPal account.
7.2.a) Payment by bank card
Credit card payments are authenticated and secured using the Sogecommerce system developed by Société Générale. As part of this operation, the Customer must provide personal information to the bank so that it can verify the identity of the cardholder and validate the transaction. Once the verification is completed and accepted, the Customer's Order is finalized. The Customer will then receive a confirmation email. The Products can only be shipped after verification of the payment method and receipt of authorization to debit the Customer's card.
The Customer's bank account will be debited at the time of shipment of the Products.
Article 8 - Reservation of Title
The Products ordered remain the property of NAVY PARIS until full payment of the price. However, the Customer will assume all risks (in particular loss, theft or deterioration) related to the Products from their delivery to the address indicated when placing the Order.Article 9 - Delivery terms
9.1. Delivery to a postal address
Products purchased on the Site can only be delivered to the following countries: [List of countries to be completed]. No Order on the Site may be made outside the aforementioned countries. The Products are shipped to the delivery address indicated by the Customer during the Order process. To avoid any delivery incident (incorrect address, wrong recipient, etc.), it is essential to provide accurate information. NAVY PARIS cannot be held responsible for any delivery incident relating to an incorrect or incomplete delivery address.
9.2. Delivery costs
For any Order between €0 and €149.99 and intended for delivery in mainland France (Corsica and DROM COM), delivery charges of €5.25 tend to apply.
For any Order greater than or equal to €150 and intended to be delivered in mainland France (Corsica and DROM COM?), delivery costs are free via the use of the promotional code "FREE". The latter is only valid for any postal address located in mainland France (Corsica and DROM COM?). For any Order less than, equal to or greater than €150 and intended to be delivered abroad, delivery costs of €14.25 tend to apply.
The amount of delivery costs is indicated including all taxes.
9.3. Delivery times
NAVY PARIS communicates the estimated delivery time with each Order. These delivery times are only estimates, are not guaranteed and cannot be invoked against NAVY PARIS. It should also be noted that this estimate does not include the time to manufacture the Products, which may be extended in the event of high demand.
NAVY PARIS assures that it will do everything possible to deliver the Products to the Customer within the time limits mentioned above.
Article 10 - Delivery problems
In accordance with legal provisions, the Products may not be delivered beyond a period of 30 days following the date of the Order. Any defect or delay in delivery exceeding this period must be reported to Customer Service. If such an exceptional circumstance should occur, NAVY PARIS undertakes to reimburse the Customer no later than 14 days following the date of termination of the Order. The Customer is required to check the conformity of the Products at the time of delivery and to indicate, if necessary, any anomalies noted (open package, damaged package and/or product, etc.) to Customer Service, as soon as possible after delivery.
Article 11 - Right of withdrawal
11.1. Right and period of withdrawal
The Customer has a legal period of 14 days from the effective delivery date of the Order, without having to justify any reasons, to return the Product(s) ordered. After this period, the Customer will no longer be able to exercise his right of withdrawal.
In the event that several Products have been ordered and these are delivered separately, the starting point of the withdrawal period will begin to run from the receipt of the last Product.
If the Customer decides to return all of the Products, the entire Order (including delivery costs) will be refunded. However, the return costs will remain the responsibility of the Customer.
If the Customer decides to return only part of the Products, only the amount of the Product(s) concerned will be refunded. The return costs will also remain the responsibility of the Customer. 11.2. Terms of exercising the right of withdrawal
To exercise his right of withdrawal, the Customer must inform NAVY PARIS of his decision to withdraw by means of an unambiguous declaration expressing his wish to withdraw, or through the withdrawal form made available to him in the package containing the Products ordered.

The procedure will be communicated to you.
The Customer may notify his decision to exercise his right of withdrawal without necessarily attaching the Product(s) concerned. In this case, the Customer has a period of 14 days following the notification of his decision to withdraw to send the Product(s) concerned. After this period, no returns will be accepted and NAVY PARIS will no longer be required to reimburse the Customer.
11.3. Restriction on the right of withdrawal
For reasons relating in particular to hygiene and health protection, the right of withdrawal can only be exercised:
on Products returned in packaging that allows their transport to the address mentioned on the return slip included in your package; on Products returned in their original condition with the label intact, without having been damaged, stained, washed, modified or worn, in their original packaging and accompanied by the original invoice.
These conditions are cumulative. Failure to comply with just one of these conditions makes it impossible for the Customer to exercise his right of withdrawal.
11.4. Consequence of the right of withdrawal
The exercise of the right of withdrawal by the Customer, in compliance with the conditions imposed by law and by these General Conditions of Sale, results in the latter receiving a partial or total refund of his Order (see Article 10.1).
NAVY PARIS undertakes to reimburse the Customer no later than 14 days following receipt of the Product(s) concerned. This reimbursement will be made using the same means of payment as that used by the Customer when placing his Order on the Site.
Article 12 - Exchange
In the event of an exchange request, the Customer is required to specify in the exchange form made available to him in the package the Product(s) he wishes to receive in exchange, as well as the size relating to them. The conditions mentioned in Article 10.3 will also tend to apply to the exchange procedure. No exchange will be accepted in the event that a single one of these conditions has not been respected by the Customer. If the amount of the Product(s) chosen as a replacement has a value greater than the amount of the Product(s) returned, the Customer will have to pay the price difference by credit card using our secure payment service. Please note that NAVY PARIS is unable to accept transfers via Paylib or PayPal for the payment of any price difference in the context of an exchange. If the amount of the Product(s) chosen as a replacement is lower than the amount of the Product(s) returned, NAVY PARIS undertakes to reimburse you for the price difference using the same means of payment as that used when placing the Order. The reimbursement will be made no later than 14 days following receipt of the Product(s) returned for exchange. In the event of an exchange, the delivery costs relating to the initial Order will be reimbursed by NAVY PARIS. The Product(s) subject to an exchange request by the Customer will therefore be delivered free of charge to the delivery address provided by the Customer. However, the transport costs relating to the Product(s) subject to an exchange request by the Customer will remain the responsibility of the latter. The exchange will take place within 3 to 5 working days from receipt by NAVY PARIS of the Product(s) returned for exchange.
