The Products sold by NAVY PARIS are subject to the legal warranty conditions provided for by Articles L.217-4 et seq. of the Consumer Code, as well as by Articles 1641 to 1649 of the Civil Code, to the exclusion of all other warranties.
Legal guarantee of conformity
NAVY PARIS undertakes to deliver to the Customer a Product that complies with its description and is free from defects in conformity, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will have the characteristics described at the time of sale. In the event of non-conformity of the Product, the Customer has a 2-year warranty from the delivery of the latter. Defects in conformity that appear within 24 months from delivery are presumed to exist at the time of delivery, unless proven otherwise. NAVY PARIS may, however, challenge this presumption if it is not compatible with the nature of the Product or with the lack of conformity invoked by the Customer. The Customer may choose between repair and replacement of the Product, unless one of these choices results in a manifestly disproportionate cost for NAVY PARIS. If the repair or replacement of the Product is impossible, the Customer may have the price paid refunded and return the Product, or keep the Product and have part of the price refunded, unless the lack of conformity is minor. The repair, replacement or refund of the Product will be free of charge for the Customer and does not prevent the possible allocation of damages – in the event that the Customer is entitled to them.
13.2. Warranty against hidden defects
NAVY PARIS undertakes to provide the Customer with a Product free of hidden defects that would make it unfit for the use for which it is intended or that reduce this use so much that the Customer would not have purchased it or would have paid a lower price for it if they had known about them. This guarantee can only be exercised by the Customer on condition that the latter informs NAVY PARIS within 2 years of discovering the defect. In the event of a hidden defect, the Customer may choose between returning the Product and having the price inherent to the Order refunded, or keeping the Product and having part of the price refunded. In all cases, it will be up to the Customer to prove that they meet the conditions of the guarantee. In the event of a lack of conformity and hidden defects, the Customer is invited to contact Customer Service so that a solution can be found.
Limitation of Liability
NAVY PARIS shall not be held liable under any circumstances for any loss or damage that does not result from a failure by NAVY PARIS to fulfil one of its obligations. NAVY PARIS shall not be held liable in the event that the failure to fulfil its obligations is attributable to the actions of a third party, the fault of the Customer or an event of force majeure as defined by Article 1218 of the Civil Code and by case law. Similarly, NAVY PARIS shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service outage, an external intrusion or the presence of computer viruses. Unless expressly stated otherwise, NAVY PARIS does not guarantee the accuracy or security of the information transmitted or obtained via the Site, due to the open nature of this Site and the possibility that errors may occur in the storage and transmission of digital information.
Applicable law – Disputes
These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law. In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, the Customer may contact NAVY PARIS Customer Service. NAVY PARIS informs the Customer that the latter also has the possibility, in the event of a dispute and before any legal action, to seek an amicable solution by resorting to a mediation procedure, in accordance with Article L.211-3 of the Consumer Code. The use of mediation is an alternative mechanism that does not constitute a prerequisite for the exercise of legal action. In the event of a dispute, the competent court will be that of the place of domicile of the defendant or, at the choice of the plaintiff, of the place of actual delivery of the Product. This Site complies with French law. NAVY PARIS cannot, under any circumstances, give any guarantee of compliance with local legislation that would be applicable in the event of access to the Site from other countries.
